RELEASE, WAIVER & INDEMNITY AGREEMENT

The undersigned (hereinafter referred to as "Rider"), being of legal age or signing in conjunction with a parent or legal guardian if not of legal age, desires to participate in cross-country horseback riding, foxhunting OR other related equine activities with Farmington Kennels, Inc., ("Farmington Hunt Club"), and being fully aware of the risk of injury and dangers inherent in the riding and handling of horses, and the EXCEPTIONALLY DANGEROUS NATURE of riding cross-country over steep and rough terrain, hereby elects voluntarily to participate in said activities, and does hereby willingly enter into this Release, Waiver & Indemnity Agreement.

THEREFORE, IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN ANY EQUINE ACTIVITY SPONSORED BY FARMINGTON HUNT CLUB, RIDER KNOWINGLY AND EXPRESSLY WAIVES RIDER'S RIGHTS TO SUE FARMINGTON HUNT CLUB, ITS OFFICERS, DIRECTORS, GOVERNORS, MASTERS, MEMBERS, VISITORS, VOLUNTEERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS, FOR ANY INJURY, DEATH, LOSS, OR DAMAGE CAUSED TO RIDER OR TO RIDER'S PROPERTY, AND RIDER AGREES TO ASSUME ALL RISKS INHERENT IN RIDING OR OTHERWISE COMING IN CONTACT WITH HORSES, INCLUDING, WITHOUT LIMITATION, THE RISKS OF INJURY, DEATH, LOSS, OR DAMAGE TO RIDER OR TO RIDER'S PROPERTY.

RIDER ACKNOWLEDGES THAT RIDER HAS BEEN GIVEN NOTICE OF THE RISKS INHERENT IN AND INTRINSIC DANGERS OF EQUINE ACTIVITIES, INCLUDING (i) THE PROPENSITY OF AN EQUINE TO BEHAVE IN DANGEROUS WAYS WHICH MAY RESULT IN INJURY, HARM, OR DEATH TO PERSONS ON OR AROUND THEM;; (ii) THE UNPREDICTABILITY OF AN EQUINE'S REACTION TO SUCH THINGS AS SOUNDS, SUDDEN MOVEMENT, UNFAMILIAR OBJECTS, PERSONS, OR OTHER ANIMALS;; (iii) CERTAIN HAZARDS SUCH AS SURFACE AND SUBSURFACE CONDITIONS;; (iv) COLLISIONS WITH OTHER ANIMALS OR OBJECTS;; AND (v) THE POTENTIAL OF A PARTICIPANT ACTING IN A NEGLIGENT MANNER THAT MAY CONTRIBUTE TO INJURY TO THE PARTICIPANT OR OTHERS, SUCH AS FAILING TO MAINTAIN CONTROL OVER THE EQUINE OR NOT ACTING WITHIN THE PARTICIPANT'S ABILITY, AND RIDER EXPRESSLY AGREES TO ASSUME ALL SUCH RISKS AND WAIVES ALL RIGHTS TO SUE FOR INJURIES CAUSED BY SUCH RISKS. THIS WAIVER AND EXPRESS ASSUMPTION OF RISKS SHALL SPECIFICALLY APPLY TO RIDER AND TO ANY AND ALL MINOR CHILDREN AND/OR WARDS OF RIDER, IN ACCORDANCE WITH THE TERMS OF THE VIRGINIA EQUINE ACTIVITY LIABILITY ACT AND SHALL BE CONSTRUED TO COMPLY WITH ALL EXCULPATORY TERMS THEREOF, VA. CODE §§3.2-6200 et seq.

IF RIDER IS A MINOR OR OTHERWISE UNDER A LEGAL DISABILITY, THIS AGREEMENT SHALL BE SIGNED BY RIDER'S PARENT OR LEGAL GUARDIAN. BY SIGNING, THE PARENT OR LEGAL GUARDIAN AGREES (i) TO WAIVE THE PARENT'S, GUARDIAN'S, AND RIDER'S RIGHTS TO SUE THE PARTIES NAMED IN THE PRECEDING PARAGRAPH;; (ii) TO ASSUME, ON BEHALF OF THE PARENT, GUARDIAN, AND RIDER, THE RISKS SET FORTH IN THE IMMEDIATELY PRECEDING PARAGRAPH, IN ADDITION TO ALL OTHER RISKS OF RIDING OR OTHERWISE COMING INTO CONTACT WITH HORSES;; AND (iii) TO INDEMNIFY AND HOLD HARMLESS FARMINGTON HUNT CLUB, ITS OFFICERS, DIRECTORS, GOVERNORS, MASTERS, MEMBERS, VISITORS, VOLUNTEERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS, FROM ANY LOSS, CLAIM, SUIT, OR JUDGMENT RESULTING FROM ANY INJURY, DEATH, LOSS OR DAMAGE SUSTAINED OR CLAIMED BY RIDER (OR RIDER'S PERSONAL REPRESENTATIVE), AND FURTHER TO INDEMNIFY FARMINGTON HUNT CLUB, ITS OFFICERS, DIRECTORS, GOVERNORS, MASTERS, MEMBERS, VISITORS, VOLUNTEERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS, FROM ANY AND ALL COSTS OF DEFENDING SUCH CLAIMS, INCLUDING ATTORNEYS' FEES.

It is expressly agreed by Rider and any parent or guardian whose signature appears on this document that this Release, Waiver and Indemnity Agreement shall be governed and construed as being sufficient to satisfy the assumption of risk and waiver requirements necessary to relieve equine activity sponsors and equine professionals from liability under the Virginia Equine Activity Liability Act, and that Farmington Hunt Club is covered by the provisions of that Act. It is also expressly agreed by Rider and any parent or guardian whose signature appears on this document that the term "Member" as used herein, specifically includes any landowner (or "Farmer" Member) whose property the Farmington Hunt Club meets on, passes through, or otherwise uses in connection with an equine activity, and that any such landowner is covered by the provisions of that Act and this Agreement.

This Release, Waiver and Indemnity Agreement shall be governed and construed by the laws of the Commonwealth of Virginia, regardless of where any injury or loss shall occur. In the event that any portion of this Release, Waiver and Indemnity Agreement shall be declared unenforceable, such declaration shall not affect the remaining terms of this document, which shall survive intact.

Rider has been advised to wear protective headgear at all times while riding or otherwise coming in contact with horses, and expressly assumes the risk of injury resulting from failure to do so and/or from selecting headgear which does not adequately protect against injury.

Hunting FAQs

  • What time are the Meets? +

During cub hunting season meets are traditionally at 8 am with later times as the season progresses. All times are subject to change, pending scenting conditions and weather. Formal season meet times are usually 10 am, or later as the season and weather require. For details consult the Fixture card, the Hunt line, the website or contact us. Plan to arrive at least 15 minutes before the meet to allow time to be ready to move off promptly at the appointed time. Remember: slow down! Be courteous to our landowners and drive slowly (15mph or less) when approaching and entering the location of the meet, giving right of way to all pedestrians and animals.

  • What is the dress code? +

In early cubbing season dress is informal and/or ratcatcher (tweed coat). Collared shirts such as “polo” shirts or turtlenecks, tucked in, are acceptable. Solid muted colors (except red) are preferred. Earth tone breeches, boots are preferred, and protective head gear (velvet covered cap with chin harness) are recommended for adults, and required for juniors.

For Formal Hunting Season, Formal Attire is required Tuesdays and Saturdays, and Ratcatcher on Thursdays. After January 1st Ratcatcher is allowed on Tuesdays and Thursdays.

  • What do I do if I want to hunt as a Visitor? +

Visitors are welcome with permission from the Master (434) 293-4467. Capping fees apply, and a signed waiver form is required. All must carry a Virginia Hunting License. The Field Secretary accepts cap fees and waiver forms at the meet.

  • How do I get directions to the meet? +

For members, log in to see the fixture card and maps. For Visitors, contact us or call the Master: 434-293-4467.

  • How can I become a Member of Farmington? +

    For more information click here.

  • I want to follow a hunt, but I do not ride. Is this possible? +

Yes, for more information contact Joy Crompton.

  • I like to trail ride and I would like to try hunting, so what should I do? +

Hunting is a thrilling sport that is best enjoyed if both you and your horse are properly prepared. Become familiar with the Hunting Protocol, contact a Master to ask permission to join a hunt, and perhaps first try hunting on an experienced mount (several members offer experienced horses for a fee).

  • I want to trail ride on land in the Farmington Hunt Club territory, is this OK? +

Only with permission granted to an individual by the landowner.

  • I want to trail ride with Farmington but I am not a member, is this possible? +

Yes! Farmington offers a popular Walk and Talk trail ride series from mid May through August. Rides are Tuesdays and Sundays from area fixtures. For more information contact Kay Butterfield, 434-823-5698.

  • How much does it cost? (Capping Fees) +

    Capping Fees:

    • Adults, $100
    • Students, $25
  • When does FHC hunt? +

We hunt on Tuesdays, Thursdays and Saturdays. Cub hunting season is early September, usually Labor Day weekend through October. Formal Hunting season opens in late October or early November. For locations, consult the Fixture Card (membership login required) or contact us for more information. Always consult the Hunt Monitor Line: 434-978-1107 for last-minute changes and updates.

  • Is a hunting license required? +

Yes, everyone who hunts (even just once) who is 12 years of age or older needs to buy an annual (or lifetime) Virginia hunting license and bring it with them to the meets. Annual rate is $18 if aged 16-64. Reduced rates if 12-15 ($8.50) or over 65 ($7.00).

va_huntinglicense_logo Buy your license online or at stores such as Kmart.

  • Waiver +

Everyone who rides in a Farmington-sponsored horse show, hunt, trail ride, hunter pace, etc. needs to sign both a Farmington Hunt Club waiver (digital) AND a Rivanna Water & Sewer Authority waiver (digital), as they own quite a bit of the land that we ride across in the Free Union area. These need only be signed once, they do not need to be signed every year.
